Terms of Service

These Terms govern TiQer Web App and TiQer Mobile Apps (Android & iOS).

1. Acceptance of Terms

By accessing or using TiQer (the "Service"), you agree to these Terms of Service ("Terms"). If you are using TiQer on behalf of a School/Institution/Organization, you represent that you have authority to bind that entity, and these Terms apply to the entity.

By accepting these Terms and using the Service, you also acknowledge and agree to the collection and use of data as described in the Privacy Policy, including camera-based image capture and geo-location features where applicable.

If you do not agree, do not use the Service.


2. Service Description

TiQer is a classroom engagement platform that enables educators to create quizzes/polls, create classes/activity rooms, add participant identifiers, start live sessions, take attendance using TiQer cards (ArUco markers), and view real-time analytics.

The Service includes: (a) a web app for setup and management; and (b) mobile apps for scanning, attendance, and in-session response capture.


3. Eligibility and Educational Use

TiQer is intended primarily for teachers, trainers, facilitators, and authorized institutional staff. Student participation must be supervised by educators or the institution.

You are responsible for ensuring your use complies with applicable laws, institutional policies, and any required permissions/consents (including parental consent where required).

3.1 Institutional Responsibility and Consent

Where TiQer is used within a School, Institution, CSR program, or organization:

  • The institution is responsible for obtaining all necessary permissions and consents from participants, including parental/guardian consent where required

  • The institution acts as the primary data controller for participant data

  • Scikraft acts as a service provider/processor and processes data as per institutional instructions


4. Accounts and Security

You must provide accurate registration information and keep it up to date. You are responsible for maintaining the confidentiality of credentials and for all activities under your account.

You must promptly notify us of any suspected unauthorized access.


5. Acceptable Use

You agree to use TiQer only for lawful educational and training purposes and in accordance with these Terms and the Privacy Policy.

You must not misuse the Service, attempt unauthorized access, interfere with normal operation, or use the Service to harm others.


6. Camera, Image Capture, and Location Use

The TiQer mobile app uses device camera and location services for core functionality including:

  • Scanning TiQer cards (ArUco markers) for attendance and quiz workflows

  • Optional capture of trainer/classroom images for attendance verification, audit, and reporting purposes

As part of this functionality:

  • Images may be captured and associated with session records

  • Geo-location (approximate or precise) may be collected at the time of capture to validate session authenticity

  • This data is used strictly for operational, reporting, and audit purposes

TiQer does not:

  • Use facial recognition

  • Collect biometric identifiers

  • Use captured data for surveillance or tracking outside the intended session context

By using these features, you agree to such data capture and usage as described in the Privacy Policy.

You are responsible for ensuring that use of camera and location features complies with applicable laws, institutional policies, and required consents.


7. User Content (Questions, Polls, Materials)

"Content" includes anything you create, upload, post, store, or otherwise provide through the Service (e.g., questions, quizzes, polls, text, images, files). You are entirely responsible for your Content and any harm resulting from it.

You represent and warrant that you have all necessary rights to submit Content and that it does not violate laws, privacy rights, or third-party intellectual property rights.


8. Content License to Scikraft

You retain ownership of your Content. However, to operate and improve the Service, you grant Scikraft a royalty-free, worldwide, non-exclusive license to host, store, reproduce, process, adapt, translate, transmit, display, and distribute your Content solely for:

  • providing the Service to you and your authorized users

  • maintaining backups and ensuring reliability

  • improving and securing the Service

This license continues for as long as your Content is stored with us and as needed for lawful purposes (e.g., backups, audit logs).


9. Content Policy

Your use of TiQer is subject to the TiQer Content Policy. Violations may result in removal of Content, suspension, or termination. The Content Policy is incorporated by reference into these Terms.


10. Intellectual Property

TiQer, including software, branding, logos, and underlying technology, is owned by Scikraft and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, reverse engineer, or create derivative works of the Service.


11. Third-Party Services

The Service may rely on third-party infrastructure and tools. Scikraft is not responsible for third-party services outside our control, though we aim to select reputable providers and apply appropriate safeguards.


12. Suspension and Termination

We may suspend or terminate access immediately if we reasonably believe you have violated these Terms, the Content Policy, or applicable law, or if your use poses a security risk.

You may stop using the Service at any time. Upon termination, your right to use the Service ends, subject to any contractual obligations with your institution.


13. Service Availability and Changes

We strive to keep TiQer available and reliable, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features for maintenance, security, or operational reasons.


14. Data Deletion and Account Closure

Users may request deletion of their account and associated personal data by contacting: info@scikraft.com

Upon verification:

  • We will process deletion requests within a reasonable timeframe (typically 7–15 working days)

  • Certain data may be retained where required for legal, audit, or contractual obligations

For institution-managed accounts, deletion requests may be routed through the respective School/Organization.


15. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.


16. Limitation of Liability

To the maximum extent permitted by law, Scikraft will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising from or related to your use of the Service.

Scikraft is not responsible for: (a) user-generated Content; (b) classroom decisions made based on analytics; (c) connectivity/device issues; (d) misuse by users; or (e) unauthorized access beyond reasonable safeguards.

Where liability cannot be excluded, it will be limited to the amount paid to Scikraft for the Service in the 12 months preceding the claim (or an alternative cap as agreed in a school contract).


17. Indemnity

You agree to indemnify and hold harmless Scikraft and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from:

  • your Content

  • your misuse of the Service

  • your violation of these Terms, the Content Policy, or applicable law

  • infringement of third-party rights


18. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Courts in Bengaluru, Karnataka shall have jurisdiction, unless otherwise agreed in a school contract.

We encourage you to contact us first to resolve disputes informally.


19. Updates to Terms

We may update these Terms periodically. If changes are material, we will provide reasonable notice. Continued use after the effective date indicates acceptance.

Annex A: TiQer Content Policy (February 2026)

Purpose: TiQer is designed for teaching, instruction, and training. Users must post only relevant educational content.

A.1 Prohibited Content (non-exhaustive)

  • Content that promotes racism, bigotry, hatred, or physical harm against any individual or group

  • Harassment, bullying, threats, or advocacy of harm

  • Sexual content involving minors, exploitation, or sexually explicit material

  • Excessive violence or graphic content

  • Content that publicly posts personal information creating privacy/security risks

  • Content that infringes copyrights, trademarks, or other rights

  • Content that furthers or promotes illegal activity or provides instructions for wrongdoing

  • Unauthorized commercial activities (contests, sweepstakes, advertising) without Scikraft's written consent

A.2 Prohibited Activities

  • Spamming, sending malware, or harmful files

  • Attempting to impersonate another user/person

  • Collecting emails for unsolicited communications

  • Criminal or tortious activity of any kind

A.3 Enforcement

Scikraft may remove Content and suspend/terminate accounts for violations, and may cooperate with lawful requests where required.

A.4 Copyright Complaints

If you believe content infringes copyright, send a notice to: info@scikraft.com with sufficient detail to locate the material and verify ownership.
